The legislation and regulations on posting have changed as of 1 January 2024. The amendments are minor. The laws and regulations have also been made clearer.
The most important changes are as follows:
Higher education is exempt from the duty to notify.
Previously, not all higher education activities were exempt from the duty to notify. Now, the exemption applies to all employees who teach, conduct research or attend scientific conferences in the sector classified under group 85.4 (Higher education) of the Standard Business Classification. Laws on working conditions continue to apply to all workers in this group. This includes, for example, the right to minimum wage and holidays.
The person responsible for pay and remuneration no longer needs to be reported to the meldloket (notification portal).
Nor do the supporting documents proving that person’s identity (for example a copy of ID card, passport or driving licence) have to be kept available for inspection at the workplace. This applies to foreign employers and self-employed people.
Notifications must be updated.
If anything changes, the foreign employer or self-employed person must modify the notification accordingly in the notification portal. For example, if there are other employees or if the workplace changes. This was already stated in the law, but has now been made clearer.
